Kathmandu. The National Folk and Dual Song Academy of Nepal has drawn attention to the artists who are making money by using other people’s song tracks in fairs held at home country and abroad. It has issued a statement saying that without the permission of the creator, using the creation of another person, he went to the country and abroad and performed on stage at fairs, festivals, and cultural events.

The statement signed by Central President Rita Thapa Magar, General Secretary Shiva Hamal, and Secretary Ghanshyam Rijal states: As there have been complaints of unauthorized commercial use of the intellectual property (music tracks) owned by various creators, promoters, presenters, and producers in music programs organized at home and abroad, the attention of all concerned is drawn not to do so.

According to this release, if the track of someone’s song has to be used, it is also mentioned in the release that it can be used only if the respective copyright holders, promoters, presenters, and producers have delegated written permission in the agreement. It has also been informed that if unauthorized use is found, there is a legal provision that may result in fines, fines, and penalties according to the requirements of the relevant copyright holders in accordance with the prevailing provisions of the Copyright Act 2059 and Regulations 2061.

In the same way, a few years ago, Royalty Collection Society Nepal and its related CMO also did correspondence, announcements, and attention-grabbing work. But their hearing could not be implemented because the artists walking into the festival ignored it. But at the moment, the biggest umbrella organization of the artists has raised the hope that it will be implemented.

It is illegal in itself to use any song of any creator or creator in a public function, fair, or festival without permission. But it is a shameful thing for the artists themselves to try to say that they are artists by using the tracks of other people’s songs at the festival. There are many people here who don’t create themselves and use other people’s creations to become singers. Due to this, there has been a decline in commercial production along with depression and distraction in the field of music in recent times.

If the organizers and artists implement this statement in the Mela Mahotsav, surely the artists will not starve to death. Now, like Mela Mahotsav, by opening live double studios and double evenings and conducting business using other people’s voices, if everyone were to unite in this way, new creations and business singers, songwriters, and musicians would be able to move forward with enthusiasm!
